I) Definitions and range
The present General Terms and Conditions of Sale, further referred to as GTCS, define the commercial relations between the company:

and the customer:

defined as the online shop user of http://fredslab.net website. The online shop is called boutique.

The GTCS cover all transaction of the marketed products of the boutique. The products being defined as software, hardware, licenses, accessories and other goodies for sale.

The GTCS do not cover third-party distributors transactions. They neither apply to engineering nor consulting services offered by Frédéric Meslin to its professional customers.

The Fred’s Lab company shall solely respect these GTCS as well as the applicable legislation. Fred’s Lab cannot be held accountable in case of non-compliance with foreign countries regulations. The customer must inquire at the local authorities before any purchase on the boutique.

Ordering on the boutique implies that the customer has read the present GTCS and fully agrees to them.

II) Amendments
Fred’s Lab is, at any time and without notice, allowed to modify the GTCS unrestrictedly. The acceptation of the customer is not required.

It is the responsibility of the customer to inquire of the GTCS before making a purchase in the boutique. The GTCS covering a transaction are those displayed on the boutique at the moment the transaction is concluded.

III) Products and stocks
Products are available as long as stocks last.

In case of stock shortage, Fred's Lab will contact the customer as soon as possible to cancel the sale and issue a refund within 5 working days.

Fred's Lab is, at any time and without notice, allowed to stop the production and marketing of a product of the boutique.

IV) Prices, rebates and taxes
EEA purchases:

The prices shown in the boutique are given in Euros, inclusive of all taxes but exclude potential packaging and shipping costs. These prices exclusively apply to sales within the European Economic Area (EEA).

Fred's Lab is, at any time and without notice, allowed to change the products prices and the packaging and shipping costs.

Outside the EEA purchases:

The prices shown in the boutique are given in Euros, exclusive of taxes and also exclude potential packaging and shipping costs. These prices exclusively apply to sales outside of the European Economic Area (EEA).

Custom duties, taxes and other importation charges may be demanded by the authorities of the countries of destination. The customer must inquire about the applicable regulations and pay the related expenses.

Rebates:

Apart from special offers, prices cannot be discounted and are non-negotiable.

Shipping costs:

Packaging and shipping costs are additional to product prices and are calculated according to distance and total shipment weight.

For a standard parcel (<2 Kg), the costs are:

- To Europe: 12 euros
- Worldwide: 30 euros

V) Reservation of property
The products ordered remain Fred’s Lab property until full payment of the order.

The transfer of the ownership of the goods is effective when the customer has actually taken possession of the goods. Loss risks, thefts or destruction during the delivery process are Fred's Lab responsibility.

Damaged packages during transportation must imperatively be refused by the customer.

VI) Orders and means of payment

The payment of a transaction can be made using one of the means of payment listed below.

SEPA bank transfer:

SEPA : European Union Countries, Iceland, Norway, Liechtenstein, Switzerland, Monaco, San Marino, Jersey Islands, Guernsey and the Isle of Man, Andorra and the Vatican State.

Along with the order confirmation number, the transfer must be made to the account below:

An incomplete transfer or a transfer without a valid confirmation number will delay the order processing.

The bank transfer must be made within 10 days after the receipt of the confirmation number. Past this time, the sale is considered null and void.

The goods will be shipped after receipt of the full payment.

PayPal Payment:

This service is operated by PayPal.

It allows payments from the Paypal account of the customer, a bank withdrawal or a credit card debit (Visa, Mastercard and American Express). Opening a Paypal account is not necessary for a credit card payment.

If paying with a currency other than Euro, conversion charges apply. These charges are paid by the customer. More information are available on: http://paypal.com

The payment must be made within 10 days after receipt of the confirmation number. Past this time, the sale is considered null and void.

The goods will be shipped after full payment.

Credit:

Fred's Lab does not offer credit facilities.

VII) Shipment
The goods sold by the boutique are shipped worldwide by our partner DHL.

The packages are shipped by registered post along with a tracking number. This number is immediately sent to the customer when the package is brought to the collection point.

"Economic" or "Express" rates are not offered by Fred's Lab.

Shipment time:

Fred's Lab will ship the goods within 5 business days. Custom orders, requiring extra work, will be sent within 15 business days maximum.

Delivery time:

Delivery times depend on the country of destination and of the potential holidays, strikes, weather events, cases of force majeure which may impact the postal services.

Generally, in Europe, deliveries are made within 4 business days.

VIII) Right of withdrawal
The customer is granted a 14 day right of withdrawal after total receipt of his order. He may return his purchases without any justification during this period.

In order to exercise this right, the customer must beforehand inform Fred’s Lab of a return by email:

The goods must be all returned in full in their original packages undamaged and clean. If not, the goods will not be accepted and will be returned to the customer at his expenses.

The return shipping costs are supported by the customer.

Once Fred’s Lab has received and accepted the return, the customer will be refunded as soon as possible. The refund excludes the packaging and shipping costs as well as the potential importation costs and taxes for customers outside the EEA.

IX) Warranty and support
Fred's Lab after sales support is available by email at:

Fred's Lab guarantees, excluding holidays, a written answer within 5 business days.

The goods sold by the boutique come with a 3 year warranty against manufacturing defects.

Repairs during the warranty period:

This warranty is limited to the free repair or replacement of the faulty products within a 3 year period following the purchase. A copy of the original invoice is required.

The warranty does not cover:

- normal wear of the products
- damages caused by failure to observe the rules of use
- damages due to negligence or carelessness of the user
- products having been modified or repaired by the user or a third person

The goods must be all returned in full in their original packages, undamaged and clean along with a copy of the original invoice. If not, the goods will neither be repaired nor replaced and will be returned to the customer at his expenses.

Past warranty repairs:

Consistently with our electronic products durability policy, genuine Fred’s Lab products bought either at the boutique or at a third-party distributor may be maintained and repaired after the warranty period is over.

X) Privacy policy
Fred's Lab website does not collect customers personal data, except the necessary information for invoicing and shipping the products. Both a printed and a digital copy of each transaction is securely kept.

Fred's Lab’s website does not install cookies on the browser of the customer.

Some third-party service providers, such as the online payment provider "paypal" or the rich content hosts “youtube" and "soundcloud" may collect data and install "cookies" on the browser of the customer. This is a consequence of the use of their services by the customer, Fred's Lab cannot be held responsible for these practices.

XI) Intellectual property
Unless otherwise stated, contents comprising: pictures, videos, illustrations, texts, binary data, source codes, digital document, present on the http://fredslab.net website are the intellectual property of Frédéric Meslin.

Apart from advertising illustrations or freely downloadable press kits, any reuse or reproduction of Fred’s Lab site contents requires a prior written authorization.

The logo of "Fred's Lab" and respective products logos cannot be reproduced on third-party hardware, software and products. Fred's Lab possesses their exclusive use.

Software or firmware available to update Fred's Lab products must exclusively be installed and executed on genuine Fred’s Lab products. Running these software on hardware other than originally intended by Fred's Lab is strictly prohibited.

XII) Competent Jurisdiction
The present general terms and conditions of sale are subject to German Law.

The tribunal of Bonn, Germany is competent in case of dispute.
