These General Terms and Conditions of Sale (GTCS) apply exclusively to transactions made directly with Fred's Lab. Transactions conducted with authorized retailers are governed by the GTCS of the respective retailer.
These General Terms and Conditions of Sale (GTCS) govern the contractual relationship between:
The Customer is defined as any natural person purchasing goods for private, non-commercial purposes via the online shop available at http://fredslab.net ("the Boutique").
These GTCS do not apply to business customers (B2B transactions), nor to services such as engineering or consulting offered by Fred's Lab.
The Boutique markets the following categories of goods:
Physical Goods: synthesizers, drum machines, eurorack modules, accessories, and similar products.Fred's Lab sells software licenses and digital content only within jurisdictions where tax and legal obligations can be fulfilled. Sales of software licenses to consumers located in the United States or the United Kingdom are excluded.
Sales of any Fred's Lab goods to North Korea, Syria, Cuba, Iran, Belarus, Russia are excluded.
By placing an order in the Boutique, the Customer confirms having read and accepted these GTCS. The version displayed at the time of order completion applies.
Fred's Lab may update or amend these GTCS at any time.
Such amendments apply only to future transactions. The GTCS version in force at the time of order placement is binding for that transaction.
Customers are responsible for reviewing the GTCS before each purchase. The applicable version is always published on the Boutique website.
Products are available while stocks last. Availability is indicated in the Boutique.

In case of stock shortages after an order has been placed, Fred's Lab will inform the Customer promptly and cancel the sale if necessary. Any payments already made will be refunded using the same payment method within 5 working days.
Fred's Lab reserves the right to discontinue the production of any product at any time.
Post-discontinuation support: Even if a product is no longer sold or produced, Fred's Lab will preserve necessary spare parts for repairs. Documentation, software, and related materials will remain available to Customers for a minimum of 10 years after the original purchase date.
Fred's Lab may reintroduce a discontinued product to the market if there is sufficient demand.
Assembly note: Products are often assembled to order, which may slightly affect shipping times.
Prices for physical goods and immaterial goods (digital content, software licenses) are shown in Euros (€).
For Customers in the European Economic Area (EEA), prices include the applicable statutory VAT.
For Customers outside the EEA, prices are shown excluding VAT.
Shipping costs are calculated based on destination zone and total weight of the order.
Customers may refer to the automated shipping calculator available in the Boutique.

Shipping is performed via DHL International, parcels are generally handled by the local postal service in the destination country.
All parcels are insured and tracked. Tracking information is provided to the Customer once the parcel is dispatched.
Customers are responsible for all import duties, tariffs, and customs charges imposed by the authorities of the destination country.
Fred's Lab does not bear or compensate for these costs.
Prices shown in the Boutique are final. Discounts or negotiations are only offered during special promotions explicitly indicated in the Boutique.
All products remain the property of Fred's Lab until the Customer has made full payment of the purchase price. Ownership is transferred to the Customer upon complete payment.
The risk of loss, theft, or damage to the products during shipment passes to the Customer only upon delivery.
Delivery is deemed completed when the parcel is handed over to the Customer or an authorized recipient.
The DHL International delivery confirmation serves as proof of delivery.
Parcels are not shipped until full payment has been received by Fred's Lab.
Parcels are shipped insured and tracked via DHL International.
Upon shipment, the Customer is provided with a tracking number. The Customer must regularly check the tracking and ensure collection of the parcel.
If a parcel is returned due to non-collection, the Customer is responsible for any re-expedition fees. Fred's Lab does not compensate for paid import duties and fees.
If a parcel arrives damaged, the Customer must refuse delivery from the carrier. Photographs of the damaged packaging and contents should be taken to support shipping insurance claims.
If a parcel is lost during transportation, Fred's Lab will resend the order free of charge.
Customers may place orders via the Boutique using the online order system, the contact form, or by email: info@fredslab.net.
By placing an order, the Customer confirms acceptance of these GTCS and agrees to pay the total purchase price.
Fred's Lab does not offer credit, deferred, or installment payment.
The Boutique is not fully automated; payments and orders are verified and processed manually.
After payment, the Customer will receive a confirmation / invoice, including a copy of these GTCS, within up to 3 working days.
If production or procurement delays occur, the Customer will be informed and given the choice to wait or cancel the order.
An order cannot be cancelled once the parcel is in transit.
All parcels are shipped via DHL International in partnership with Fred's Lab.
Parcels will be handled by the local postal service in the destination country as part of DHL's network.
Parcels are insured and tracked. Tracking information is provided upon shipment.

Products are mostly assembled to order, which may affect shipping times. Customers are informed of expected delivery periods at order confirmation.
Delivery is completed when the parcel is handed to the Customer or an authorized recipient.
DHL International delivery confirmation serves as proof of delivery.
Fred's Lab does not ship orders to North Korea, Syria, Cuba, Iran, Belarus, Russia, or occupied areas of Ukraine.
Customers are granted a 14-day right of withdrawal after receipt of the order.
Products may be returned without providing any reason during this period.
To exercise the right of withdrawal, the Customer must notify Fred's Lab by email: support@fredslab.net.
Returned goods must be complete, undamaged, clean, and in original packaging.
The Customer is responsible for return shipping costs, including customs charges for non-EEA returns.
Once Fred's Lab has received and accepted the return, the Customer will be refunded as soon as possible.
For customers within the EU/EEA, refunds are processed in accordance with Directive 2011/83/EU: the full purchase price and the cost of standard delivery will be refunded. Return shipping costs remain the responsibility of the Customer unless otherwise agreed.
For customers outside the EU/EEA, refunds cover only the purchase price of the goods and exclude original shipping, and any import duties/taxes.
Digital goods (software licenses, downloadable content, presets) are not subject to withdrawal once delivery has started.
Custom or personalized products may also be excluded from the right of withdrawal, if specified at purchase.
Customers are encouraged to use tracked shipping for returns.
Fred's Lab will inspect returns and reject those that do not meet conditions, returning them at the Customer's expense.

Written responses are typically provided within 1–3 working days, excluding holidays.
All products sold by Fred's Lab come with a 3-year warranty against manufacturing defects, starting from the original date of purchase.
This warranty is in addition to the consumer's statutory rights, which remain unaffected.
The warranty is transferable: second-hand owners are covered for the remainder of the original 3-year period, provided they can present the original purchase invoice.
The warranty is limited to free repair or replacement of faulty products.
A copy of the original invoice is required to claim the warranty.

Goods must be complete, undamaged, clean, and in original packaging, along with a copy of the invoice.
Goods not meeting these conditions will not be repaired or replaced and will be returned at the Customer's expense.
Fred's Lab may provide repairs after the warranty period in line with the company's durability policy.
Customers must request a quote before sending items for out-of-warranty service.
Products not purchased directly from Fred's Lab are covered by the retailer's warranty, not Fred's Lab.
Fred's Lab may assist with information, but warranty claims must be handled by the selling retailer.
Fred's Lab provides mostly free updates for critical software bugs.
Addition of functionalities or improvements requested by Customers is at the discretion of Fred's Lab, without any contractual timeline.
Fred's Lab preserves spare parts, documentation, and software for a minimum of 10 years after purchase, even if the product is discontinued.

Reference schematics for each product are available on the corresponding product page of our website.
At Fred's Lab, we take data privacy seriously.
Personal data is stored on secured servers with technical and organizational measures to protect against unauthorized access, loss, or misuse.
Fred's Lab collects only the personal information necessary to process orders and provide invoices/shipping.
Examples include: name, shipping address, email address, and payment details.
Minimal personal data is also transferred to DHL International and subcontractors for shipment.
The accounting office receives personal data solely for invoice processing and backup.
The Fred's Lab website uses a session on the client's browser to store shop basket content.
The shop is not usable if cookies are declined.
PayPal may use cookies to process payments.
Creating a user account requires only an email address. No other personal data is collected.

Unless otherwise stated, all contents on the Fred's Lab website, including pictures, videos, illustrations, texts, binary data, source code, digital documents, manuals, presets, and designs, are the intellectual property of Frédéric Meslin.
The logos of Fred's Lab and its products are protected and cannot be reproduced on third-party hardware, software, or products.
Content purchased from Fred's Lab, including presets, manuals, designs, and software, is provided solely for personal use with genuine Fred's Lab products.
It is strictly prohibited to use any Fred's Lab content to train AI models or for other AI-related data processing.
Software or firmware updates must be installed and executed only on the intended Fred's Lab hardware.
Apart from advertising illustrations or freely downloadable press kits, any reuse or reproduction of Fred's Lab content requires prior written authorization.
Digital goods (software, presets) are subject to a separate End-User License Agreement (EULA), defining rights and limitations of use.
Fred's Lab reserves the right to trigger legal action against any individual or entity that violates its intellectual property rights or uses its content in violation of these terms.
Legal enforcement may include injunctions, damages, and other remedies available under applicable law.
Fred's Lab provides all products, including hardware, software, and digital content, "as-is".
Customers purchase and use products at their own risk.
Fred's Lab makes no guarantee that products are fit for a particular purpose beyond their intended use.
While Fred's Lab provides mostly free updates for critical software bugs, the addition of new functionalities or improvements is at Fred's Lab's discretion and without contractual timeline.
Fred's Lab is not liable for indirect, incidental, or consequential damages, including loss of data, income, or production.
Liability is limited to direct damages caused by gross negligence or willful misconduct, to the extent permitted by law.
These General Terms and Conditions of Sale are governed by German law.
Statutory jurisdiction rules apply, i.e., disputes may be brought at the consumer's place of residence in accordance with EU law.
Consumers may also use the European Commission’s Online Dispute Resolution (ODR) platform.
Fred's Lab, however, is not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
These terms apply exclusively to B2C transactions via the Fred's Lab online boutique.
B2B transactions or professional services are governed by separate agreements.
